How to Get a K-1 Visa?

A K-1 fianc(e) visa is a nonimmigrant visa for a foreign born man or woman who wishes to come to the United States and marry a U.S. citizen fianc(e). A U.S. citizen can petition for his or her foreign fianc(e) to come to the United States if the couple has met each other in person within the last two years.

To obtain a K-1 visa, a U.S. citizen has to file a fianc(e) petition on behalf of his or her foreign born fianc(e). Upon approval of the fianc(e) petition and completion of all the required forms, a U.S. consulate or embassy abroad will interview the foreign fianc(e) and issue a K-1 visa. A K-1 fianc(e) visa will be valid for ninety days. Within ninety days of entry into the U.S., the foreign fianc(e) must either marry the U.S. citizen fianc(e) or return to his or her home country. If the foreign fianc(e)s minor children wish to come to the United States with their parent, they can obtain K-2 visas.

A foreign fianc(e) who marries a U.S. citizen fianc(e) can apply for a Green Card (officially called a Permanent Resident Card) which will allow him or her to permanently stay in the United States. In order to apply for a Green card, a fianc(e) who entered the United States on a K-1 visa must marry a U.S. citizen within 90 days of arrival. Then, the spouses must prepare and file all the necessary documents for a Green Card application.
